La obligación solidaria para el pago de las multas: una de las varias maneras de vulnerar el principio de responsabilidad personal en materia sancionatoria

Abstract

One of the great challenges for the exercise of the sanctioning power of the Administration consists
of the identification of the offender, when the offense is identified by automated technological means.
In the case of traffic violations, the Colombian legislator attempted to introduce a joint obligation
between the owner and the driver of the vehicle. The attempt was contained by the Constitutional Court
of Colombia. Faced with this, personal obligations of the owner were foreseen, in order to make him
responsible for the infractions committed by the driver. Now, the Constitutional Court, unfortunately,
tolerated it.
