When faced with a critical situation requiring an immediate response, local authorities have three distinct tools at their disposal: accelerated procedure, negotiated procedure without prior publication, and emergency procurement. Accelerated procedure primarily involves the reduction of specific statutory deadlines to expedite the standard administrative path. In contrast, the negotiated procedure without prior publication and emergency procurement are two distinct award procedures that, in the current legal landscape, tend to overlap in their application. This article, which maintains a strong practical focus, seeks to delineate the specific boundaries of these three contractual instruments for crisis response while proposing potential areas for improvement within each mechanism to ensure more effective public management.
