Abstract

This paper analyzes the complex legal framework of forest biomass within the context of the European energy transition and its transposition into the Spanish legal system. Starting from the European Climate Law and the "Fit for 55"package, it examines the regulatory evolution from the RED II Directive to RED III (Directive 2023/2413), highlighting the strengthening of sustainability criteria and the institutionalization of the cascading use principle. The study focuses in detail on the Spanish Draft Royal Decree regulating aspects of biomass for energy production in Spain, analyzing new restrictions on financial support, the reduction of power thresholds, and safeguards to protect the timber industry and biodiversity.  Finally, the proposal to create a national scheme for the verification of sustainability and GHG emission reductions within the solid biomass sector in Spain is assessed as a strategic tool to simplify the administrative burden on small rural suppliers, ensuring that forest biomass acts as a driver for rural development and fire prevention under a framework of legal certainty and verifiable sustainability.
