Aspectos orgánicos del recurso especial en materia de contratación pública en las comunidades autónomas

Abstract

The need to adapt the system of administrative appeals in the field of public contracts established in Act 30/2007 to European Union Law brings the question of the competence for its resolution. The solution adopted is the articulation of a “centralized” administrative body and, at the same time, allowing the Autonomous Communities to create their own bodies that will decide the appeals falling under the area of their competence. Until now, only three Autonomous Communities have created these bodies, but other ones have already presented several projects or have authorized their creation. This article describes how these bodies have been articulated: it analyzes how their design guarantees their independence in order to decide the appeals in the field of public contracts.
