15 years have been elapsed since the entrance into force of town planning crimes. A quick look to judicial statistics is enough to see that the number of cases in this field is very low and, therefore, it would be easy to conclude wrongly that thanks to the Criminal Code this kind of crimes barely occur. This is not true. There are very and different problems related to these crimes. It is possible that the cause of the lack of judgments in this field would be the irresolution of these problems. This article describes and analyzes the technical and legal problems of these crimes and, at the same time, it responses in technical and legal terms to them. Therefore, this article examines carefully and from a practical standpoint this matter with the aim to better understand the complexity of town planning from a criminal law standpoint.
