Abstract

This article analyzes the debate about the execution of judgments in the area of civil service where the execution is basically circumscribed to the mandatory execution of judgments in the case that the public administration has not comply voluntary with it. In this event, the citizen may execute the judgment in the terms of section 104.2 LJCA. The article explores several hypotheses about mandatory execution and the incidents that may occur in this arena. In particular, it examines the controversy about the no execution and the execution of judgments in the area of recruitment processes, disciplinary issues and money judgments. The study finalizes with the analysis of two connected questions that are very relevant in practice: the extension of the effects in the area of human resources and the hypothesis of public administration responsibility that can derive in the area of execution of judgments.
