Ayuda financiera de las diputaciones catalanas a los ayuntamientos

Abstract

Town and city councils are facing serious financial problems that can lead to the suspension of payments. This situation can even jeopardize the existence of these public administrations. The financial aid of Catalan intermediate local governments (diputaciones) could be articulated as follows: (1) with the participation of towns and city councils in the Unified Plan of Works and Services (UPWS) which design corresponds to the Catalan Government, and (2) directly and independently of the Catalan Government when the financial aid is articulated outside the boundaries of UPWS. In order to apply the benefits of the judgment 159/2011 of the Spanish Constitutional Court, the actions of Catalan intermediate local governments designed outside the UPWS and independently from the Catalan Government, must (1) fall in the category of “singular project for the local and urban development” or (2) co-financed by a European Union Plan. These transferences carried out by Catalan intermediate local governments fall in the scope of application of the General Act of Public Aids and therefore are subject to its provisions.
