Abstract

This article examines the power to pass municipal ordinances and the limits that establishes the principle of the rule of law regarding the sanction of new conducts and, in general, when the sanction power is exercised. This article focuses on the recent case-law on the security and coexistence municipal ordinances in relation to the sanction power of the municipality; the regulation of the full-body veil, nudism, vagrancy and begging, prostitution in the public space; the non-pecuniary sanctions, the confiscation of goods or the culpability in the infractions framework and the accountability related to sanctions.
