Between the closure of the current city councils and the constitution of the new ones

Abstract


The periodical calling for local elections leads to the rethinking, every four years, of several questions related to the public activity that derives from the renewal of the local entities. Inter alia, it is relevant the end of the term of the elected officers (its effects and consequences); the liquidation of the outgoing administration; or the process of constitution of the new administration and the election of the new major which have shown some issues that remain unresolved by the legal framework. Indeed, in relation to the ending of the term of office, relevant questions remain unsolved like the scope and powers of the “interim government” and the automatic dismissal of the temporary staff and their current legal framework. Moreover, in relation to the constitution process of the new corporation, there are relevant issues unresolved such as the preliminary activities of the constituent meeting or the assumption of the office and the election of the new major.
