The “innovative” public procurement in the new Directive 2014/24/EU

Innovation is one of the pillars of the Europe 2020 strategy for smart, sustainable and inclusive growth which considers public procurement crucial for achieving these goals. These European priorities have been implemented in our domestic law by successive amendments to the Law 30/2007 of 30 October, regarding Public Sector Contracts. However, the new directives –“fourth generation directives”– on public procurement include multiple new initiatives about the concept of “innovative” public procurement. The main novelty of Directive 2014/24/EU of the European Parliament and of the Council of 26 February 2014, is the establishment of a specific award procedure so-called “innovation partnership” for the development of new products, services or carry out innovative works and the subsequent acquisition of the resulting supplies, services and works. Thus, the European legislator has launched more flexible procedural avenues for facing the challenges of the public sector.
