The procedural requirements of the individual constitutional complaint (recurso de amparo): the exceptional motion for a reversal on procedural grounds and the requirement of a “special constitutional relevance” (especial trascendencia constitucional)

Abstract

This article studies the procedural requirements of the individual constitutional complaint (recurso de amparo) and it distinguishes between time requirements, the foundations and development of the previous judicial process and the requirements of the individual constitutional complaint. The article also carries out a detailed analysis of the most important questions that matter in the procedural practice. For instance, the article explores the necessity to use the exceptional motion for a reversal on procedural grounds in order to exhaust all the judicial remedies before submitting the individual constitutional complaint before the Spanish Constitutional Court (recurso de amparo) and it also analyzes the requirement of the “special constitutional relevance” (especial trascendencia constitucional) of the individual constitutional complaint as a requirement for its admissibility.
