Entrustment of management tasks and administrative agreements

Abstract

This article pursues a twofold aim: first, a specific and complex analysis of the entrustment of management tasks institution, and second, the study of a less specific topic, such as administrative agreements. Between the two topics there is a common connection, because normally the entrustment of management tasks adopts the form of an administrative agreement. However, the new legal regime provided by LRJSP is not applicable to the legal institution of the entrustment of management tasks and, therefore, it is necessary to rely on the regulation of the LCSP regarding the entrustment of management task to the “own resources” of the entity which entrust the tasks. There are few new developments introduced by the LRJSP regarding the institution of the entrustment of management tasks, its regulation may be defined as fragmented and full of legal vacuums. To the contrary, the regulation on administrative agreements is broaden and of general application. This fact justifies a different of treatment in this article, although both institutions would deserve a deeper analysis.
