Implementing the Law on transparency in local entities

Law 19/2014, of 29 December, on transparency, access to public information and good government, is applicable to all local entities in Catalonia, as well as to all their bodies and dependent entities. This article analyzes this issue and discusses some thoughts and proposals. First, the article studies some interadministrative mechanisms whose goals are to implement the Law and to guarantee the equality of citizens. In this context, the article refers to the Transparency Portal, the Register of Lobbies and the Guarantee Commission of the Right to Access to Public Information. Second, the article analyzes the duty to provide information of individuals and legal entities which collaborate with the public administration. In relation to the right to access to public information, the article deals with the inadmissibility causes of applications and provides some guidelines to interpret the vague concepts of the Law. Finally, the article gives some thoughts regarding the issue of the meaning of administrative silence in the field of applications on the right to access to public information; especially it refers to the irrelevance in practice of this mechanism. Moreover, the article comes up with a proposal about when public administrations should not grant the right to access to public information through positive administrative silence, based on the restrictions legally established for accessing to the information.
