Abstract

The prohibitions and restrictions in public employment, established in the annual budgetary laws, are leading to the ageing of the public personnel, an increase of the temporal employment and a higher economic cost in the long term, weakening the principles of equality, merit and capacity. At the same time, taking into account the abuse of the temporality, the article argues the violation of Directive 1999/70/EC, which obliges the promotion of employment policies avoiding temporality.
