The regulation of local consortiums

Abstract

This article analyzes in detail the historical evolution of the legal framework of consortiums, before and after the entrance into force of Law 27/2013, of 27 December, on rationalization and sustainability of local administration. The article examines the innovations of Law 15/2014, of 16 September, on the rationalization of the Public Sector and other administrative reforms such as the legal framework of Law 40/2015, of 1 October, on the Public Sector. The article explores the legal framework of local consortiums and, particularly, it analyzes the supervening unconstitutionality of Autonomous Communities legislation on local consortiums because of the entrance into force of the new basic State laws. Finally, the article critically analyzes the current legal framework and highlights the pros –such as the unitary legal framework– and cons, in particular, the adscription system of public services.
