The new legal framework of liability of public administrations. The recent case law from the local law perspective

Abstract

The article addresses the changes introduced by Law 39/2015, of 1 October, on the Administrative Procedure of Public Administrations and Law 40/2015, of 1 October, on the Public Sector, regarding the liability of the legislator because of passing unconstitutional legislation or in contradiction with European Union Law. In addition, the article studies the recent case law on liability of the legislator because of breaching European Union Law when the central and local administrations are involved.
