Abstract

Better or smart regulation is a consolidated phenomenon in the international and European spheres, although its impact at the local level has been reduced if we take as a reference other levels of government and administration. This article studies briefly the precedents of better regulation in general and, afterwards, it focuses its attention on the local level and the Spanish case. The article studies the case law which annuls municipal regulations and urban planning because of poor legislative technique. In this context, the new Spanish legislation on better regulation is analyzed and the article studies its impact on the local level. Finally, the article concludes with some challenges at the local level.
