About the prohibited negotiations and activities of civil servants and the abuse of office

Abstract

This article describes several criminal infractions in which the author, normally a public authority or a civil servant, carries out actions in which, taking advantage of his/her authority, damages or injures the principles of impartiality and objectivity. The crimes commented in the article are related to heterogeneous conducts, but they are characterized for private interests interfering public affairs and a subject taking advantage of his/her position leaving aside the principles above mentioned.
These crimes oblige to reinforce the administrative rules aimed at preventing them and to pursue the proper functioning of the Administration. These crimes have raised in recent years because of the increase of corruption, a corruption that seems not to have and end, sensitizes public opinion and projects a sense of impunity.
