Specialties of public procurement in local law after Law 9/2017, of 8 November, on Public Contracts

Abstract

Law 9/2017, of 8 November, on Public Contracts, is fully applicable to all local governments. However, the legislator recognizes some specialties. One of them is the relevance of small amount contracts as basic and key tools in the field of local public contracts. The other entails the difficulty of applying a dense, demanding and technical legislation to municipalities with poor management capacity and scarcity of resources. In this context, it appears the role of intermediate local governments which, taking into account the new legal reforms, should assist municipalities in complex issues such as public procurement law.
