Constitutional doctrine on the control by surveillance cameras

Abstract

The article studies the rules and case law over the control by surveillance cameras and its use potentially in breach of fundamental rights enshrined in Article 18 of the Spanish Constitution (right to honour, privacy, own image, protection of home, secrecy of communications and personal data protection); as well as human dignity and equivalent rights protected by the European mechanisms of protection of human rights. The article pays especial attention to the case law of the Spanish Constitutional Court, the European Court of Human Rights and the Court of Justice of the European Union.
