Prohibition on contracting and incompatibilities of councilors

Abstract

Public procurement is subject to limitations that pursue to safeguard the general interest and avoid possible conflicts of interest. One of them is the one that directly affects the councilors. The Law on Public Procurement establishes a set of circumstances in which there is a prohibition on contracting, inter alia, one of those affects the councilors who cannot combine their elected status with that of a contractor with the municipal corporation itself. This article addresses the complex regime of incompatibilities of the councilors and the prohibition on contracting, analyzes its regulation in the Law on Public Procurement and its renvoi to local laws, incompatibility and electoral laws.
