Analysis of the practical application of the Public Sector Contract Law; special reference to the most complex sections regarding its process of elaboration

Abstract

The application of Law 9/2017, of 8 November, on Public Sector Contracts, which transposes into the Spanish legal system the Directives of the European Parliament and of the Council 2014/23/EU and 2014/24/EU, of 26 February, after two years in force, calls for a first approximation of the pending challenges, one of them, to which we will devote special attention, will be the correct conceptualization from the point of view of European Union law, focusing on the functional concept of the public contract and, in particular, it scope, as well as the operation of transparency in procedures.
