The survival of a legal framework of social services in Spain: the integrated system of Catalonia

Abstract

The constitutional and statutory legal framework configures a specific system of welfare benefits, based on the recognition of a right of access to social services for all citizens of Catalonia, in the context of emerging from the economic and social crisis, in which the Spanish State was immersed. Likewise, this legal framework determines the distribution of material and functional competences of the public social protection system between the administration of the Catalan Government (Generalitat) and the local administration, at its various levels; under the perspective of the constitutional interpretation of the 2013 reform of the local legal system. Along these lines, Law 12/2007 on Social Services involves the consolidation of the provision model in accordance with the principles of universality, proximity and decentralisation.
