The Administrative Tribunal of Contractual Appeals

Abstract

This article studies how public procurement receives special attention from the standpoint of the European Union, which obliges Member States to have a special monitoring mechanism in this field. This mechanism is the special appeal in the matter of public procurement. The Administrative Tribunal of Contractual Appeals is in charge of this special appeal and it is a quasijurisdictional body which is able to restore the specific legal situation of the contractor. Its composition is characterized by the impartiality, functional independence, specialization, and professionalization of its members, all in view of guarantee a fast and efficient appeal.
