The principle of effectiveness as a link between law and economy

Abstract

In the social, democratic and a rule of law state, certain values must be respected in order to democratically legitimize public action and ensure the effectiveness of public decisions. The Spanish Constitution of 1978 refers to effectiveness as a guide of the public powers inasmuch as they have to make freedom and equality real and effective. Furthermore, effectiveness means to manage and regulate public services and economic sectors where the market and the public converge and, therefore, public action entails public intervention in the economy, supervision of markets and planning.
