Competition law and public procurement law

Abstract

Competition law is having a great impact on essential aspects of our public law, especially because of the pressure exerted by European Union law. One of the most significant manifestations of this phenomenon is its effect on public procurement law. This article addresses the application of competition law in contracting processes and the difficulties it entails in various aspects, particularly from the perspective of legal certainty, considering the purely jurisprudential nature of a large part of the applicable legal framework.
