Professional public management in local governments. General framework and analysis of two Autonomous Communities’ regulations: Euskadi and Catalonia

Abstract

This article analyzes the essential elements of the legal framework of professional public management of local governments, considering state basic legislation and some Communities Autonomous regulations (Catalonia and Euskadi), where specific proposals have been made in that regard. The Spanish Supreme Court judgment of December 17 of 2019 has had a special impact on that field, particularly for the Catalan regulation. The differences between such regulatory proposals, although offering some common elements, are relevant; and they are explained because of the different regulatory intensity of such matter, but also due to substantial aspects such as the greater or lesser application of the those regulatory provisions in each case.
