Transparency, access and good administration: a comparative study between Italy and Spain

Abstract

The article compares Italian and Spanish legislation on transparency, both inspired by the US model establish in the Freedom of Information Act. The analysis is based on the principle of transparency as a value that should inspire the action and organization of public administrations and as a right to access to public information. The article analyzes the main differences between the Spanish and Italian legal systems regarding the protection and effectiveness of administrative transparency. The article concludes that both in Italy and in Spain transparency and the right to access to public information have undergone a slow metamorphosis and, from the perspective of fundamental rights of the individual, they have become tools to fight corruption that only indirectly satisfies the right to access to public information of the citizens.
