"WHERE WHAT GOES?" THE PROBLEMS OF THE LEGAL REGULATION OF THE OBLIGATION OF SEPARATE DELIVERY OF HOUSEHOLD WASTE: CERTAINTY, DOUBTS AND INSUFFICIENCIES.

As a means to reflect on the quality of regulation in Spain of the collection, treatment and recovery of waste, we try to discern the fraction in which the most common domestic waste must legally be deposited in the twenty most populated municipalities in Spain.
After analyzing the limited impact of European and basic regulations on the matter, the ordinances of those cities are studied in relation to the different fractions, also evaluating an instrument without a regulatory nature, but whose limited but undoubted legal impact is also analyzed: the guides and instructions that the respective municipalities direct to their citizens.
The article concludes with a critical evaluation of the regulation analyzed, focusing on its lack of precision, its dissociation from reality and necessity, as part of a comprehensive response to the ecological challenges we face, its renewal together and coordinated with the infrastructure and planning and communication tools that also integrate the waste collection, treatment and recovery systems.
