Abstract

The Spanish Constitution of 1978 establishes that administrative action must be subject to the rule of law and serve the public interest Criminal law criminalizes some conducts to guarantee the compliance of public authorities with these principles. It is the case of the undue influence peddling, a conduct in which the public administration or the public employee does not behave according to the public interest but in favor of a private third party which pursues an economic benefit for himself or a third party.
