Town planning powers and planning agreements from the perspective of Catalan town planning law

Abstract

Planning agreements sometimes satisfy the town planning needs and interests, but also in other occasions prevail the patrimonial interests of either private subjects or public entities. The complexity, the unstable regulatory framework, the delay of town planning proceedings and the economic and financial crisis, all of them are factors which stimulate planning agreements as a shortcut and safe avenue. It should be arguing that town planning law serves the general interest and this relevant aim should not be relegated, postponed or overloaded by the mere balance between the interests of the parties, albeit respectful, which are economic and patrimonial interests by nature.
