Vote of confidence and no-confidence motion

Abstract

The city councilors cannot be dismissed by political reasons, only under a legal numerus clausus causes. To the contrary, the mayor can be dismissed also under specific mechanisms provided by LOREG and connected to political reasons: the vote of confidence and the no-confidence motion. These mechanisms may be activated directly by the political opposition or by the decision of the mayor for overcoming deadlocks, but always there are the expression of the power to review and control the public power. However, there are multiple causes which have caused difficulties in the application of these mechanisms and have affected the principle of legality. Inter alia, the defective and inefficient original regulation, the always changing regulation, the legislative changes because of political defection, the confusing intervention of the Spanish Constitutional and Supreme Courts regarding the treatment of political defection or th relation of the vote of confidence and the approval of the municipal budget. For all these reasons, this article analyzes in depth these two mechanisms at the municipal level.
