Petitions, applications and actions. An opportunity for the right to petition vis-à-vis the unnecessary antiformalism

Abstract

This article analyzes the right to petition in light of the praxis of simple applications provided by the administrative procedural law. It discusses solutions to avoid defenselessness in cases in which the applicant misleads petitions and applications or even procedural actions. The article explores all these questions taking into account the common ground of all these mechanisms, i.e. the exercise of rights that motivate an act, conduct or performance.
