The aggregation of local demand: the creation and adhesion to central procurement boards

The article analyzes, from a legal perspective, public procurement by local entities through central procurement bodies. The article shows an overview of the regulation of central procurement boards in Law 9/2017, of 8 November, of Public Contracts and, afterwards, it addresses the rules of creation of different types of central procurement bodies and the possibility to be adhered by local entities. Moreover, the article explores whether in the contractual documentation of the framework agreements issued by the central procurement bodies should be established the adhered entities which are the beneficiaries of the services, which is a key controversial issue. To conclude, the article highlights the need to think about the convenience of implementing a better coordinated and consistent model of aggregation of demands in all the territorial levels.
